Unpaid Overtime and Misclassifications
In California, the general overtime laws are that a nonexempt employee shall not work more than eight (8) hours in any work day or more than forty (40) hours in any work week, unless he or she receives one and one-half times (1½) his or her regular rate of pay for all hours worked over eight hours in any work day and over 40 hours in the work week.
Overtime pay violations may occur when employees who are covered by the California Labor Code and/or the Federal Fair Labor Standards Act (FLSA) are designated by employers as exempt employees. Such misclassifications may be due to a misunderstanding of the law or with the intentional purpose of cutting labor costs. Employers may also erroneously classify workers as independent contractors who should be paid as employees.
